Terms and conditions

These terms apply to orders for Website Atelier designs and the related digital services (copywriting, Launch Package, Care Plan) placed with Javier Sugo, Javier Sugo Strategy, Seitenstettengasse 5/37, 1010 Vienna, Austria ("I", "me"). Consulting and custom website projects are governed by the individual offer.

1. The service

I personalize one of the website designs shown in the Website Atelier with the content you provide (texts, photos, names, links and details), or with texts I write for you at no extra charge if you prefer. I then create a hosting account on the Netlify free plan with your email address, publish the website there and check that everything works. To connect your domain, I send you the exact setting to enter at your domain company, and you enter it. Finally I send you the account login and a folder with all the files of your website. This is a personalized digital service made to your specifications. The domain is bought and paid by you from a registrar of your choice and is not included in the price. The hosting account and the domain remain in your name.

2. Order request, payment and contract

Sending an order request on this website is not yet a binding order and no payment is taken here. I confirm the order and send a payment request by email. The contract is concluded when you accept the confirmation and complete the payment. Prices are shown in euros. 3. Your content

After payment you send your content through the content form: a description of your project and what you need, your texts (or your request that I write them), your photos and your domain name. You also confirm the verification email that Netlify sends to your address. Work starts only when everything is complete. If the content is still incomplete 14 days after payment, the order is cancelled [with or without refund, and any fee for work already done]. You confirm that you hold the rights to all texts, photos and logos you send, and that the content is lawful.

4. Delivery

Delivery times are counted on business days, Monday to Friday; weekends are not counted. Your website is live within 24 to 72 hours on business days after I have received everything: all information and photos, the domain, and your confirmation that the hosting account is verified. With the Express delivery extra, within 24 to 48 hours on business days.

5. Changes

Every order includes 3 review rounds, which can be used during the 14 days after the website goes live. A round is one complete list of changes sent in a single message. I apply each round within 2 business days (Monday to Friday). If I write the texts for you, your review of the texts counts as part of these rounds. Rounds cover reasonable changes: adjustments to the texts, photos, colors and layout of the purchased design, not a different design. Rounds not used within the 14 days expire. After the 14 days the project is complete; you keep the account login and all the files, and later changes are available as a paid service or under the Care Plan.

6. Extras and services

The price includes up to 2 languages chosen from English, French, Spanish, German, Italian and Portuguese. I write and translate the texts into the included languages at no extra charge. Further languages are available as paid extras (1 or 3 extra languages). Express delivery shortens the delivery time to 24 to 48 hours on business days. The Care Plan is a separate service available only on javiersugo.com: your website is hosted on my own Netlify account, and I publish your changes and maintain it. It is billed monthly and can be cancelled with one month notice.

7. Right of withdrawal

If you are a consumer in the EU, you generally have a right of withdrawal of 14 days (FAGG). This right does not apply to services made to the consumer's specifications or clearly personalized, and for services it ends once the service has been fully performed, if you expressly agreed that I start early. 8. Rights of use

After full payment you receive a non-exclusive, perpetual right to use the delivered website for your own business, event or project. The underlying design may be offered to other customers in personalized form.

9. Warranty and liability

Statutory warranty rights apply. I am not responsible for hosting providers, domain registrars or third-party services. [Liability wording after lawyer review (KSchG limits)]

10. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection rules of their country of residence remain unaffected. Place of jurisdiction for businesses is Vienna.
